Withdrawal and complaints

Consumer information about withdrawing from the contract and reporting faults.

This document applies if you are a consumer, that is, if you are not buying the service in the course of business. It describes when you may withdraw from the contract and what to do when the service does not work as it should.

If you bought the subscription in the App Store or on Google Play, the seller is Apple or Google respectively. Refunds are then handled directly with them under their policies — we have no access to such a payment.

1. The right to withdraw within 14 days

You may withdraw from a distance contract within 14 days of the day it was concluded, without giving a reason and without penalty.

The deadline is met if you send the notice no later than the last day of the period.

2. When the right lapses

Brainee is a digital service that starts working immediately. If you expressly ask for immediate performance and at the same time acknowledge that you thereby lose the right to withdraw, the right lapses once the service has been supplied in full.

We ask about this with a checkbox at the order, so that it is clear what you are confirming. If you do not request immediate performance, the service becomes available after the period expires.

The trial is free, so no payment is involved. If you cancel before it ends, nothing is charged.

3. How to withdraw

Send us an unambiguous notice at ahoj@brainee.eu. You may use the model form below, but it is not compulsory.

We will confirm receipt without undue delay. We will refund you within 14 days of the withdrawal, by the same means you paid, unless we agree otherwise. The refund costs you nothing.

If you asked for immediate performance and withdraw within the period, you pay a proportionate part of the price for what you used up to the withdrawal.

5. When the service does not work as it should

A digital service must match what we promised and keep working throughout the subscription. If it does not, you have the right to have the defect removed.

Report a defect by e-mail at ahoj@brainee.eu. Write what is not working, when it happened and what device and app version you have — that is how we find it fastest. We will confirm receipt and deal with it without undue delay, at the latest within 30 days.

If we do not remove the defect within a reasonable time, or it cannot be removed, you have the right to a reasonable discount or to withdraw from the contract. On withdrawal we refund the proportionate part of the price for the period the service did not work.

6. Out-of-court dispute resolution

If we cannot reach agreement, you may turn to the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, adr.coi.cz, which is the body for out-of-court settlement of consumer disputes. The procedure is free of charge for consumers.

You also have the right to go to court; the out-of-court route is voluntary.
