Terms of Service
The rules under which we provide Brainee and you use it.

These terms govern the use of the Brainee app and related services. The provider is Filip Zemánek, Company ID (IČO) 14207893, registered office Prakšice, Czech Republic, registered in the Czech Trade Licensing Register kept by the Municipal Office of Uherský Brod (the “provider” or “we”). By using the app you agree to these terms. If you do not agree with them, do not use the app and do not create an account.
1. What Brainee is
Brainee is a mobile app for iOS and Android with a supplementary web interface. It turns a dictated or typed sentence into tasks, estimates how long they take and builds a daily plan out of them. It also provides a weekly review of how your time was spent.
Brainee is a planning tool. It is not a medical service, not professional advice, and not a tool whose output should be relied on where an error cannot be tolerated. Its suggestions are an estimate and it is up to you whether you accept them.
2. Your account
To use the app you create an account. The details you give at registration must be true and kept up to date. You are responsible for protecting your credentials and for activity carried out under your account.
An account belongs to one person. Sharing your credentials with other people is not allowed.
The service is available to people aged 16 and over. We do not provide it to anyone younger.
3. Subscription and pricing
A new account gets a free trial period and continues on the paid Pro plan afterwards. Current prices are on the Pricing section of the website. Prices are final.
The provider is not registered for VAT. For purchases through the App Store and Google Play, tax follows the rules of the relevant store and may be added to the price depending on the country of your account.
Paid plans are charged in advance for the chosen period (a month or a year) and renew automatically until you cancel. We will e-mail you at least seven days before an annual subscription renews.
The trial lasts 14 days and is free. If you do not cancel during the trial, the subscription becomes paid. The trial can be used once per account.
We may change prices. A change never affects a period you have already paid for — we will announce it at least 30 days in advance and you may cancel before it takes effect.
4. Who the seller is
This depends on where you buy the subscription, and it determines who handles payments and refunds.

For purchases through the Apple and Google stores, the terms of that store apply alongside these. You cancel such a subscription in your account settings in that store, not in the app.
5. Cancelling
You can cancel at any time. Cancelling means the subscription will not renew — the service keeps running in full until the end of the period you have paid for.
We do not refund the unused part of a period already paid for unless the law requires it. Consumer withdrawal rights are set out in a separate document.
6. How you may use the service
You use the app for your own needs or for the needs of the organisation your account belongs to. You must not:
- circumvent technical measures or try to reach other people's accounts or parts of the system that are not yours,
- put automated load on the service beyond ordinary use,
- upload content that infringes someone else's rights or is unlawful,
- record other people's voices without their knowledge where the law does not allow it,
- resell or rent the app or pass it off as your own.
For a serious or repeated breach of these rules we may limit or close the account. Where circumstances allow, we will warn you first and give you room to put it right. If we close an account on our own initiative, we refund the proportionate part of the subscription for the unused period.
7. Artificial intelligence
We use third-party services for speech transcription and for analysing text. The result is a machine estimate — it may contain errors, a wrong time, or a task you did not mean. Check a suggestion before you rely on it.
The content you put into the app stays yours. We do not use it to train public models and we do not pass it on for that purpose.
8. Availability
We aim to keep the service running continuously, but we do not guarantee it will be free of outages. Planned maintenance will be announced in advance. Unplanned outages, force majeure and failures of the services Brainee depends on are not a breach of these terms.
Features evolve. We may change or remove one. If it is a feature you took out the subscription for, we will tell you in advance and you may cancel with a proportionate refund.
9. What we promise and what we answer for
Brainee is a planning tool. We do not promise a suggestion will always be right — it is a machine estimate and it is up to you whether you accept it. We are not liable for the consequences of decisions you make on that basis.
If you are a consumer, we are liable to you under the law and we do not limit that in advance in any way.
If you are a business, our liability for damage is limited to the amount you paid for the service in the preceding twelve months. This does not apply to damage caused intentionally or by gross negligence, or to harm to a person's natural rights; there liability is not limited.
10. Personal data
How we handle personal data is described in the Privacy document. Businesses using Brainee for their people are provided with a data processing agreement on request.
11. Changes to these terms
We may change these terms. We will announce a material change at least 30 days in advance by e-mail and in the app. If you do not agree with it, you may cancel before it takes effect and we will refund the proportionate part of the unused period.
12. Governing law and disputes
The relationship is governed by the law of the Czech Republic. If you are a consumer, this does not deprive you of the protection given by the law of your country of habitual residence.
We will try to settle any dispute by agreement — write to ahoj@brainee.eu. Consumers may also turn to the Czech Trade Inspection Authority (Štěpánská 567/15, 120 00 Prague 2, adr.coi.cz) as the body for out-of-court settlement of consumer disputes.
